Welcome to notesDiary! These Terms of Use ("Terms") govern your use of the notesDiary mobile application and related services (collectively, the "Services") provided by fox.AI("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

Eligibility

You must be at least 13 years old to use the Services. By using the Services, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.

Account Creation and Security

To use certain features of the Services, you may need to create an account using your Apple login or other login method. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. We reserve the right to suspend or terminate your account if we suspect any unauthorized access or use.

Intellectual Property Rights

The Services and all content and materials included therein, such as text, graphics, logos, and images, are owned by or licensed to us and protected by intellectual property laws. You may not modify, reproduce, distribute, or create derivative works based on the Services without our prior written consent.

User Conduct

You agree to use the Services only for lawful purposes and in compliance with these Terms. You shall not:

• Harass, abuse, or threaten other users;

• Post or transmit any offensive, obscene, or infringing content;

• Interfere with the security or functionality of the Services;

Privacy Policy

Subscriptions and Billing

​

The Services offer subscription plans, including monthly and 6-month options. Payment will be charged to your Apple ID account at the confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions through your Apple ID account settings.

Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure. Your use of the Services is at your own risk.

Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services. Our total liability shall not exceed the amounts paid by you for the Services in the preceding 12 months.

Termination

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in San Francisco, California.
